ARTS AT WORK: PRIVACY POLICY

GENERAL

Arts At Work (“AAW”) operates and offers the AAW website, including all information, tools and services available from the AAW website, to all users of the AAW website including, without limitation, users who are browsers, customers, featured artists and/or content contributors (“AAW Users”), whose acceptance is limited to the Terms & Conditions as shown in the ARTS AT WORK: TERMS & CONDITIONS policy (“Terms”).

By visiting or using any part of the AAW website and/or purchasing something from AAW, AAW Users agree to be bound by all of the Terms contained therein and/or available by hyperlink.

While AAW assumes no responsibility to do so, AAW reserves the right to update and/or change information, tools, features and services of the AAW website at any time, which updates/changes shall also be subject to the Terms contained therein.  It is the responsibility of AAW Users to periodically check the ARTS AT WORK: TERMS & CONDITIONS page for any updates/changes, where the most current version of the Terms will be disclosed.  Following the posting of any updates/changes, the continued use of or access to the AAW website by AAW Users constitutes acceptance of any said updates/changes.

The AAW website is hosted by Bluehost Inc. (“Bluehost”). In addition, AAW uses Mijireh Checkout (a subsidiary of Reality66 LLC, “Mijireh”) and Beanstream Internet Commerce, Inc. (Canada) (“Beanstream”), which companies together provide AAW with secure and PCI compliant online e-commerce platforms that allow AAW to sell artworks to AAW Users (see “SECTION 4 – MIJIREH and BEANSTREAM” below).

SECTION 1 – PERSONAL INFORMATION PROVIDED BY AAW USERS

When AAW Users purchase something from the AAW website, as part of the buying and selling process, AAW collects the personal information provided by AAW Users such as their personal name, address, phone number and email address and/or the name, address, phone number and email address of the company that AAW Users are authorized to represent.

When AAW Users browse the AAW website, AAW also automatically receives the internet protocol (IP) address of the computer of AAW Users in order to provide AAW with information that helps AAW learn about the browser and operating system of AAW Users.

Email marketing: With the permission of AAW Users, AAW may send emails about the AAW website, new artworks and other updates to AAW Users.

SECTION 2 – CONSENT

When AAW Users provide AAW with personal information to complete a transaction, place an order, verify a credit card or arrange for a delivery, the consent of AAW Users for the provision of said personal information is implied for those specific reasons only.

Should AAW request personal information from AAW Users for another purpose, such as marketing, AAW will either ask AAW Users directly for expressed consent or provide AAW Users with an opportunity to decline.

AAW Users may withdraw their consent to be contacted by AAW and/or for the continued collection, use or disclosure of their personal information, at any time, by contacting AAW at info@artsatwork.ca or at:

SECTION 3 – DISCLOSURE

AAW may disclose the personal information of AAW Users if required by law to do so or if AAW Users violate the ARTS AT WORK: TERMS & CONDITIONS policy.

SECTION 4 – MIJIREH and BEANSTREAM

The AAW website does not collect or store any credit card information.

AAW uses Beanstream as its payment gateway provider. The AAW website also uses Mijireh for collecting and transmitting credit card information obtained from the AAW website checkout page to Beanstream, which companies together provide AAW with the online e-commerce platforms that allow AAW to sell artworks to AAW Users.

All purchase transaction/credit card data processed by Beanstream is encrypted at the highest security level (Level 1) through the Payment Card Industry Data Security Standard (PCI-DSS), the standards of which are managed by the PCI Security Standards Council (a joint effort of brands like Visa, MasterCard, American Express and Discover). Mijireh is also PCI-DSS compliant.

Beanstream stores the respective purchase transaction/credit card data only as long as is necessary to complete the purchase transaction, after which time the respective purchase transaction/credit card data is deleted.

The purchase transaction/credit card data of AAW Users is stored through Beanstream’s data storage, databases and the general Beanstream application on a secure server behind a firewall.

The AAW website is further protected through Sitelock Domain Security.

SECTION 5 – THIRD-PARTY SERVICES

In general, the third-party providers used by AAW will only collect, use and disclose the personal information of AAW Users to the extent necessary to allow them to perform the services they provide to AAW.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information AAW is required to provide to them for the purchase-related transactions of AAW Users.

For these third-party providers, AAW recommends that AAW Users read their respective privacy policies to understand the manner in which the personal information of AAW Users will be handled by these third-party providers.

In particular, certain third-party providers may be located in or have facilities that are located in a different jurisdiction than either AAW or AAW Users. Should AAW Users elect to proceed with a transaction that involves the services of a third-party service provider, then the personal information of AAW Users may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

Should AAW Users click on links on the AAW website, the AAW Users may be directed away from the AAW website. AAW is not responsible for the privacy practices of other websites and AAW Users are encouraged to read the respective privacy statements of said other websites.

Once AAW Users leave the AAW website or are redirected to a third-party website or application, AAW Users are no longer governed by this PRIVACY POLICY or the ARTS AT WORK: TERMS & CONDITIONS policy.

SECTION 6 – SECURITY

To protect the personal information of AAW users, AAW takes reasonable precautions and follows industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

Please refer to “SECTION 4 – MIJIREH and BEANSTREAM” (above) for information regarding security of purchase transaction/credit card data of AAW Users.

AAW has also implemented an additional generally accepted industry standard, Sitelock Domain Security, for the AAW website.

SECTION 7 – AGE OF CONSENT

By using the AAW website, AAW Users represent that they are at least the age of majority in their state or province of residence.

SECTION 8 – CHANGES TO THIS PRIVACY POLICY

AAW reserves the right to modify this privacy policy at any time. Changes and clarifications will take effect immediately upon their posting on the AAW website. If AAW makes material changes to this policy, AAW will notify AAW Users here that it has been updated.
